Oh, Look. Another Crooked Judge

This is BS. A Michigan parent was trying to get course information on a class called “History of Ethnic and Gender Studies.” The school refused to release it. She sued under the state’s Freedom of Information Act.

Judge Jacob James Cunningham determined on December 15 that public school teachers are exempt from producing school-related documents in response to FOIA requests because they are not considered “public bodies” and, therefore, their documents are not considered “public records.”

Public schools are not “public bodies”? Let’s see what Michigan law actually says about that.

(2) A public body shall exempt from disclosure information that, if released, would prevent the public body from complying with 20 USC 1232g, commonly referred to as the family educational rights and privacy act of 1974. A public body that is a local or intermediate school district or a public school academy shall exempt from disclosure directory information, as defined by 20 USC 1232g, commonly referred to as the family educational rights and privacy act of 1974, requested for the purpose of surveys, marketing, or solicitation, unless that public body determines that the use is consistent with the educational mission of the public body and beneficial to the affected students. A public body that is a local or intermediate school district or a public school academy may take steps to ensure that directory information disclosed under this subsection is not used, rented, or sold for the purpose of surveys, marketing, or solicitation. Before disclosing the directory information, a public body that is a local or intermediate school district or a public school academy may require the requester to execute an affidavit stating that directory information provided under this subsection will not be used, rented, or sold for the purpose of surveys, marketing, or solicitation.

Public schools — as opposed to private schools — specifically are “public bodies” under 15.243 Sec. 13. There are some exemptions; but those relate to students’ personal data, not curriculum material.

So, Judge Jacob James Cunningham, if schools are — as you claim — not public bodies, why does the law make special personal data exemptions for those very schools?

Maybe Cunningham isn’t crooked. Perhaps he’s merely an idiot, ignorant of his state’s law.

Health officials worried after Florida Supreme Court approves DeSantis’ COVID-19 vaccine probe
Florida Gov. Ron DeSantis petitioned the state’s supreme court earlier this month for an order to impanel a statewide grand jury to probe any wrongdoing related to COVID-19 vaccines. The court gave him the green light on Thursday.

This has a number of health officials and so-called experts worried about the impact that this truth-finding mission may have on vaccine hesitancy and the public’s faith in the medical establishment.

And I shouldn’t need faith* in in the medical establishment. I should be able to have confidence in it, based on performance.

Beautiful Story of Kindness Amidst Chaos in Buffalo
Despite the sad stories of damage, fatalities and looting, there are heartwarming stories coming out as well.

Twitter user Kimberly La Russa shared the beautiful story of a 64 year old mentally disabled man, Joey, who was saved from the frigid conditions, and probable death, by a kind stranger, Sha’Kyra Aughtry.

Older mentally disabled man caught out in the snow. He cries for help, and strangers rescue him and take him into their home, and get him defrosted. She gets on Facebook to ask for help, while her kids keep the poor guy entertained and distracted from his pain.

More strangers fire up a snow plow and dig them out and take the man to the hospital, where he’s being treated in the burn unit for severe frostbite.

Strangers doing the decent thing simply because they could.

Maybe I won’t write off America just yet.

Atatiana Jefferson Killing: Manslaughter

So the jury let ex-cop Aaron Dean off with a mere manslaughter conviction for killing Atatiana Jefferson in her home as he snuck around unannounced at 2:30 in the morning.

“Put your hands up! Show me — BANG — your hands.”

I said three years ago that he should be convicted of murder, and I respectfully disagree with the jury and still say it was murder.

Advocating for overthrowing the US m and Constitution really doesn’t go over well at TZP.

And yes; he really did argue that the very Constitution that he claims is completely invalid magically gives Congress the power to impose whatever gun control it wants.

TZP recently had a visit from a troll. “Allan” claimed that Congress has the power to impose whatever gun control it wants via Article 1, Section 8 of the Constitution, because it has the “power to regulate the “Militia”.

If that’s all there was to it, I would — and did — note that his reading of the Constitution was incomplete, that Congress only has that power over “such Part of them as may be employed in the Service of the United States.” Congress gets to regulate only those called up for federal service; something that hasn’t happened lately.

However, “Allan” also chose to denigrate Americans as “nuts, “fans”, and “paranoid yokels.” In addition to my reply, he earned a flag for future moderation. Sadly, that flag was needed. He came back.
